Terms of Service
Please read these terms of service carefully before using our platform
Welcome to Mubashirun (the “Community Instance”), powered by the Communitly Platform, a software-as-a-service solution provided by TreeRoots Software LTD, a company registered in England and Wales (Registered Office: Hawthorne House, 17a Hawthorne Drive, Leicester, LE5 6DL) (“we”, “us”, or “our”).
These Terms of Use ("Terms") govern your access to and use of this Community Instance and the underlying Communitly Platform. By using this service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
1. Definitions
• “Platform” refers to the Communitly software-as-a-service (SaaS) platform operated by TreeRoots Software LTD.
• “Community Instance” refers to a branded environment created by a Client on the Platform. In this case, the Community Instance is Mubashirun at https://services.mubashirun.com.
• “Client” refers to the organisation that operates a specific Community Instance using the Platform (e.g. Mubashirun).
• “We”, “Us”, “Our” refers to TreeRoots Software LTD.
• “You”, “User” refers to any individual or business accessing or using a Community Instance.
2. Scope of Agreement
These Terms apply to your use of both:
• The Communitly Platform (authentication, data processing, communications tools); and
• The Community Instance you are accessing, which is operated by our Client (e.g. Mubashirun).
You may also be subject to community-specific rules or guidelines set by the Client.
3. User Accounts
To access certain features, you must register for an account. You agree to provide accurate and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We reserve the right to suspend or terminate your account if you violate these Terms.
4. User Content
You may upload, post, or submit content through the Service, including but not limited to text, images, and other materials (“User Content”). You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display it in connection with the operation and promotion of the Service. You are solely responsible for your User Content. You agree not to upload or share any content that infringes any third party’s rights or is unlawful, defamatory, or otherwise inappropriate.
4A. Platform Features and Permitted Use
The Platform provides the following core features for use within each Community Instance:
• User Accounts – Register, access services, submit content, and interact with other users.
• Business Listings and Profiles – Create and manage verified business profiles.
• Messaging and Communication Tools – Send and receive messages for legitimate community engagement.
• Reviews and Ratings – Post genuine reviews for listed services.
• Marketplace and Offers – (If enabled) Buy goods/services via one-time payment.
• Subscription Management – Access premium features, manage/cancel plans.
• Community Moderation Tools – Admin-only tools to manage users/content.
All features must be used lawfully and in accordance with these Terms. Features may be modified, restricted, or removed at any time.
5. Ownership and Intellectual Property
All intellectual property related to the Platform, including but not limited to the source code, system architecture, UI components, software features, and documentation, is and shall remain the exclusive property of TreeRoots Software LTD.
Any trademarks, logos, custom branding, or proprietary content submitted or uploaded by the Client (e.g. Mubashirun) remains the property of the Client.
Nothing in these Terms transfers any ownership rights to Users.
6. Feedback and Suggestions
If you provide us with feedback, ideas, or suggestions, you agree that we may use them without compensation or attribution. You waive any moral rights in such feedback.
7. Subscriptions and Billing Terms
Business users may subscribe to a paid plan in order to access additional features such as business listing visibility and promotional tools. Subscription options may include monthly, 6-month, or annual billing cycles.
Payments are processed securely via Stripe, and you agree to Stripe’s own terms and privacy policies in connection with your payment method.
Your subscription will automatically renew at the end of each billing cycle unless cancelled prior to the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will prevent future billing but will not affect or refund the current billing period, during which your subscription benefits will remain active.
No partial refunds or pro-rata credits are issued for cancellations made mid-cycle.
We reserve the right to modify subscription offerings, pricing, or billing frequency with reasonable notice to you.
8. Promotions, Contests, and Sweepstakes
We may offer promotions, contests, or sweepstakes from time to time. These may be subject to additional terms and conditions, which will be made available at the time of participation.
9. Prohibited Activities
To maintain the integrity, trust, and safety of the Platform and all Community Instances operated on it (e.g. Mubashirun), you agree not to engage in any of the following prohibited activities. These activities are strictly forbidden and may result in account suspension, content removal, or legal action:
Platform Integrity & Misuse
• Data Harvesting or Scraping – Accessing or collecting data using bots, scrapers, or similar tools, except as permitted by standard search engine indexing.
• Reverse Engineering – Copying, modifying, decompiling, or extracting any part of the Platform without express written permission.
• Circumvention of Access Controls – Attempting to bypass security restrictions, subscription gating, or admin-only permissions.
• Framing or Impersonation – Replicating or framing the Platform in a misleading way.
User Conduct
• Misrepresentation – Creating fake accounts or impersonating individuals or businesses.
• Fraud – Engaging in deceptive behavior such as inflating reviews or misrepresenting offerings.
• Platform Competition – Using the Platform to recruit users away to competing services.
• Harassment – Abusing or threatening users, administrators, or support staff.
• Inappropriate Content – Posting hate speech, explicit content, threats, or misinformation.
Communication & Messaging
• Spam – Sending unsolicited, irrelevant, or mass messages.
• Data Harvesting – Collecting personal data for use outside the intended Platform functionality.
• Malware – Uploading harmful files or using tracking pixels or spyware.
Business Listings & Representation
• Badge Misuse – Falsely using designations like “By Community Team” or similar labels.
• Deceptive Offers – Publishing misleading promotions or prices.
• Fake Listings – Creating vague, placeholder, or fraudulent business listings.
• Duplicate Listings – Posting the same business/service multiple times to manipulate visibility.
Legal and Regulatory Compliance
• Illegal Activity – Using the Platform for anything that violates laws or regulations.
• IP Infringement – Uploading content that violates copyrights, trademarks, or IP rights.
Platform Abuse or Interference
• System Exploits – Overloading backend services or exploiting platform vulnerabilities.
• Support Abuse – Filing false reports or misusing support tools.
Enforcement
Violations may result in:
• Temporary or permanent account suspension
• Removal of content or listings
• Termination of subscriptions without refund
• Reporting to legal authorities if necessary

Violations of these Terms may result in actions including, but not limited to, temporary or permanent suspension of your account, removal of content or listings, termination of subscriptions without refund, or reporting to relevant authorities where required by law.
11. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. TreeRoots Software LTD disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.
To the fullest extent permitted by law, TreeRoots Software LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.
12. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Platform. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance.
13. Data Ownership and Responsibility
All data submitted or generated within a Community Instance—including but not limited to user profiles, business listings, reviews, communications, and interactions—is owned and controlled by the Client operating that Community Instance.
TreeRoots Software LTD processes such data on behalf of the Client and does not claim ownership over it. We act as a data processor, and the Client is the data controller, as defined under the UK General Data Protection Regulation (UK GDPR).
We process this data solely for the purpose of delivering the Platform and related services, in accordance with applicable laws and our Data Processing Agreement (where applicable).
Users acknowledge that their personal and business data may be accessed, reviewed, and managed by the Client administrator(s) responsible for that Community Instance.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
